Course Description

This course combines an introduction to health law and policy with a comparative analysis of health systems in several high-income and middle-income countries. The goal of this course is to provide an outline of the ways that health law frames and guides the health system in the United States. It includes an analysis of some of the strategies for using legal levers to influence the health system to achieve public policy goals that include expanding coverage, reducing costs, or improving the quality of health care. The comparative analysis of health systems provides the opportunity for students to develop a dynamic analysis of the functioning of the health system in the United States. A comparative analysis of health systems in several other countries addresses questions of how the dynamic interactions between stakeholders enable those health systems to move close to achieving the full set of goals embedded in Universal Health Coverage. This analysis will open space for asking new questions concerning the functioning of the health system in the United States. This will, in turn, enable a deeper analysis of the processes by which health law creates a framework for the health system and of the strategies available to policymakers for influencing the outcomes produced by the health system. This course is offered in an online, asynchronous format, with 6 (six) to be announced synchronous sessions from noon 1pm ET. There will be 3 synchronous sessions in June and 3 synchronous sessions in July.

Course Description

This online asynchronous class teaches students the key documents of the American Legal System and how to find and use these documents both in traditional legal research databases like Lexis and Westlaw and in the many free websites available on the internet. The class will also discuss secondary sources like periodical literature and legal treatises that assist in understanding and interpreting laws, court opinions, and administrative regulations. Students will learn how to use all of these sources in academic projects like seminar papers as well as in students everyday professional lives. Students will also learn to employ strategies to conduct their research efficiently and effectively. The course is designed for professionals and students (no JD/LLM/LLCM) who want to gain a thorough understanding of U.S. legal research methods to inform their work and studies.

Course Description

This course, which is designed for non-law students, will examine the fundamentals of administrative agencies. Such agencies formulate rules and regulations that dramatically impact modern life. Most products, technologies and commercial activities are subject to a broad array of regulations promulgated and enforced by federal agencies aimed at assuring health and safety (e.g., by the EPA, OSHA, FDA); fair and efficient markets (e.g., by the SEC, CFPB); and progress toward other public policy goals set by Congress. The modern administrative state is fraught with controversy. Are governmental agencies a practical necessity in today's complex world, or do they represent an increasingly inappropriate delegation of decision-making? Additionally, with President Trump's announcement of a new Department of Government Efficiency to be run by Elon Musk and Vivek Ramaswamy, with a mandate to "dismantle government bureaucracy, slash excess regulations, cut wasteful expenditures, and restructure federal agencies," the regulatory state is sure to be in the news during this course term. Major themes in the course will include: - Why do agencies exist? - How are agencies created? - What powers to agencies have? - Political control of agencies. - Judicial control of agencies. - Judicial review of agency action.

Course Description

This course offers an intensive and practical survey of the critical legal and transactional matters facing start-ups and emerging businesses. In an interactive environment using a combination of case analysis, class discussions, presentations, and real-world insights, students will learn about the foundational legal considerations involved in starting a business and establishing a sustainable organization. Topics include choice of business form; corporate governance; labor and employment law; intellectual property; privacy, data protection, and cybersecurity; capital raising; and common deal structures. By the end of the course, students will be equipped with an understanding of the legal fundamentals of creating, operating, and growing an enterprise.Students must complete a final group project and write an end of semester paper. Attendance is mandatory (including during Add/Drop period) unless prior arrangements are made with the professor.

Course Description

This summer semester survey course is designed to introduce the non-law student to the fundamentals of US law and legal methods. It serves as both a stand-alone course for Penn juniors, seniors and graduate students seeking a greater understanding of the US legal system, and a point of entry into the Law Schools upper level curriculum for those students pursuing joint degrees, certificates or ad hoc coursework.
The course will use case law to illustrate and teach all topics. It will feature the Socratic method, which utilizes questioning and debate between professor and student to stimulate critical thinking and to develop understanding of the matter under discussion. The course will begin with an inquiry into the structure of government and the foundations of the US legal system. It will consider the sources of US law, and the concepts of federalism and separation and balance of powers. As it examines the US Constitution, it will review the fundamental notions of due process, equal protection, freedom of speech and religion, and other constitutionally protected rights. The course explores the difference between the civil and criminal justice systems, between public and private enforcement, and between the state and federal judicial systems. It will survey civil procedure and the litigation process, personal injury and tort law, contracts and business law, property law, criminal law and criminal procedure, family law and estates, and administrative law and procedure. This rigorous course demands significant class preparation time and will require robust class participation by all students.
JD, LLM, and LLCM students are not permitted to take this class.
